Samsung Refrigerator Defects, Complaints and Class Action Lawsuit

Samsung's Defective Refrigerators -

There are two obvious design failures with many Samsung French door refrigerators:

  1. Ice maker failures
  2. Fridge compartment failing to cool properly.

In both cases, moisture freezes inside the unit and fails to drain, which eventually causes the ice maker to fail and/or the fridge compartment fan to make noise (as it hits the ice build up) then the fan fails and the fridge compartment cannot maintain cooling. Theoretically, if the air in your house is very dry (you  live in an arid region, or keep you house air conditioned to 68 F or below, all of the time, the problem would not be as big or evident.

The bottom line

These are well-documented problems with a large number of Samsung refrigerators.  There are countless complaints filed and even a class action lawsuit.

There is NO permanent fix, this is a design problem.  Some repairs help a bit (such as sealing the ice maker compartment) but ultimately the fan in the fridge section fails when ice builds up there.

But Samsung is a big corporation, which appears to place it's profits above your concerns, and the lawsuit may be stalled forever, so your best bet is to take the fight to Samsung directly to get repairs and refunds for free.

Class Action Lawsuit Against Samsung

The class action lawsuit filed in 2017 claiming that Samsung refrigerators suffer from an ice tray defect has been in mediation for over a year. continues to be negotiated. The lead plaintiffs Ronald and Debra Bianchi claimed that a defect in Samsung refrigerators with French door external dispensers causes a number of problems, including leaks, slush, over freezing, and excessive fan noise.

The case is Bianchi, et al. v. Samsung Electronics America Inc., et al., Case No. 2:17-cv-01263, in the U.S. District Court for the District of New Jersey.

The allegedly affected models include: RF23HCEDB, RF23HCEDT, RFH23HSESB, RF23HTEDB, RF23J9011, RF24FSEDB, RF25HMEDB, RF263BEAE, RF263TEAE, RF26J7500, RF28HDEDB, RF28HDEDT, RF28HFEDB, RF28HFEDT, RF28HFPDB, RF30HDEDT, RF31FMEDB, RF31FMESB, RF323TEDB, RF32FMQDB, RF34H9950, and RF34H9960 in all colors.

Join the Facebook support group

This Facebook group provides quite a bit of useful information and tips on how to get the repairs.

The group recommends you stand on the implied warranty not the manufacturers warranty. All appliances carry the implied warranty, which means the appliance is free of known defects at sale. But these defects ARE known and that can be proven!

Other tips:

 If you need to deal with Samsung directly, because your Fridge is still in warranty, only call the Office of the president of Samsung at 1-888-480-5675. Remember to say "It's not a warranty issue it is a design defect!"

 Stand on the legally implied warranty not the manufacturer's warranty!!! Implied means free of known defects at sale and these are known and proven..........

California and Indiana:

If you live in Indiana or California, Samsung is required to make refunds 7 years from warranty expiration.

You MUST have the defective Appliance in your possession in order to receive refund..If you need to, put it in your garage or basement and keep it plugged in at all times. NEVER defrost , tech needs to see what is going on .

More Tips

  1. Save all receipts and work tickets for repairs, purchase, everything.
  2. Document EVERYTHING completely.  Video, photos do help,
  3. Record photo calls with techs, Samsung, Store, anything related.
  4. File complaints (see below)
  5. If If the repair tech uses a blow dryer, take photos (they may claim YOU damaged the unit with a blow dryer)

Most appliance repairmen interviewed said they found Samsung and LG make the least reliable refrigerators and Whirlpool makes the best.  Of course that can change quickly.

 

How to file a complaint against Samsung

First, file these three complaints:

 

  1. File an online complaint with the New Jersey Better Business Bureau (NJBBB), even if you do not live in NJ.
    Use this address for Samsung:

    File a complaint here.

    The first 2 questions are all NO (unless of course they Do apply, in which case you are not filing a complaint with the BBB).

    Be sure to answer "yes" to the question "Did this issue occur within the last 12 months?"

    And answer YES to "Is it in warranty?"

  2.  File a complaint with the NewNew Jersey Attorney's General office, NJAG Consumer Affairs Office

  3. File with SaferProducts.gov for food loss: You should get up to $500
